Offenses Committed While Operating a Motorcycle

Basic Description: Presently, these two bills are written differently. We are watching them closely and will notify you of any changes.

137 - Provides additional penalties for certain offenses committed by person operating or in actual physical control of motorcycle; requires person be taken into custody; provides for seizure & forfeiture of motorcycle; provides for revocation of person's privilege to operate a motorcycle.

802 - Provides that if a person is operating or is in actual physical control of a motorcycle while driving recklessly, a law enforcement officer shall arrest the person, take him or her into custody, and seize the motorcycle. Requires that a person riding on a motorcycle or moped must ride while sitting astride the seat with one leg on each side and with both wheels on the ground at all times, etc.

Both Bills has been rewritten and have accomodated most of the ABATE concerns on Discrimination, but they are still problematic and address pre-existing law.
Commentary: While the intent may be to curb motorcycle stunt drivers getting crazy on the highway and putting others at risk, it incorporates confiscation issues that have not been resolved. The new version now includes "motor vehicles".
